Terms of Service

These terms are an agreement between you and Company X, the temporary legal operator of And Then You. By creating an account or joining a family, you agree to them. The service is for adults and is not directed to children.
Your account
You must be 18 or older and legally able to enter this agreement. Keep your sign-in details private, enable two-step sign-in where possible, and tell us straight away if you think someone else has access. You are responsible for what happens under your account until you notify us of unauthorised access.
Your authority to record a child
You may create a child profile or add information about a child only if you are that child’s parent or legal guardian, or you have clear permission from one. You must use the service in the child’s best interests and respect their privacy, dignity and changing wishes as they grow older.
If parental responsibility is shared, restricted or disputed, you are responsible for ensuring that creating the profile, inviting family members, and recording or sharing memories is lawful. And Then You cannot decide family or guardianship disputes. We may restrict access while a credible safety or authority concern is investigated.
Families and roles
The person who creates a family becomes an admin. Admins can invite and remove members, add and edit children's profiles, and see every memory in the family. Contributors can add memories and see only their own. Admins can edit or delete any memory in their family, including ones you wrote.
Only invite people who should have access to information about your children. Once someone is an admin, they can see everything recorded about the children in that family. Admins are responsible for reviewing membership, removing access when it is no longer appropriate, and protecting the interests of each child.
Your content
You and your family retain ownership of the memories, photos, recordings and other original material you upload. Company X does not take ownership. You give us a limited, non-exclusive, worldwide licence to host, copy, process, transcribe, display and format that content only as needed to operate, secure and provide And Then You, including assembling keepsakes you request. The licence ends when the content is deleted, except for temporary backups and lawful retention.
You confirm that you have the right to upload what you upload, including photos of children and of other people, and that doing so does not break any law or anyone else's privacy, confidentiality, copyright or other rights. A family member must not upload content merely because they can access it elsewhere.
Content contributed to a family becomes part of that shared family record. A family admin may edit or delete it, and removing the contributor does not automatically remove their contributions. Contributors should keep their own copy of anything they do not want to depend on the family admin preserving.
Keepsakes, sharing and ownership
A keepsake is created from your family’s content. Your family continues to own that underlying content, and Company X claims no ownership of the finished family keepsake. The And Then You name, software, layout system and service design remain ours or our licensors’ property.
The admin who publishes, exports, downloads or shares a keepsake is responsible for selecting its contents and recipients and for having the authority to include every child and other identifiable person shown. Once a file, printout, screenshot or shared copy leaves the private service, we cannot control further copying or disclosure. Do not share a keepsake publicly unless everyone with authority has agreed and the child’s interests have been considered.
Acceptable use
You agree not to use And Then You to:
- upload unlawful, abusive or exploitative material, especially involving children;
- upload sexualised, exploitative or otherwise harmful content involving a child;
- upload content about people without the authority or permission required;
- attempt to access another family's content, or interfere with the service;
- use information from the service to harass, shame, profile or endanger someone;
- resell or redistribute the service.
We may suspend or close accounts that break these rules, and we will report illegal material involving children to the authorities.
Keepsakes and paid features
Recording memories is free. Publishing or exporting a keepsake may be a paid, one-off purchase. Prices and what each purchase includes are shown before you pay. Before an immediately supplied digital keepsake is unlocked, we may ask you to expressly request immediate supply and acknowledge any effect this has on your EU cancellation right. Nothing in these terms removes refund, cancellation or consumer rights that Irish or EU law does not allow us to exclude.
Availability
We work hard to keep the service running and your memories safe, but we provide it "as is". We do not promise it will never be unavailable. Keep your own copies of anything irreplaceable.
Ending your account
You can stop using And Then You at any time and ask us to delete your family's content. We may end or suspend access if these terms are broken, or if we have to stop offering the service — in which case we will give you reasonable notice and a chance to download your memories.
A request from one family member to delete shared content may affect other family members and people represented in it. We may verify the requester’s identity and authority, consult relevant admins where appropriate, and prioritise a child’s legal rights and safety.
Liability
Nothing here limits liability that cannot legally be limited. Otherwise, our total liability to you is limited to the amount you have paid us in the twelve months before the claim, to the extent Irish law permits. Nothing here affects mandatory consumer rights or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of Ireland. The courts of Ireland have jurisdiction, but if you are an EU consumer you may also have the right to bring a claim in the courts where you live and to rely on mandatory local consumer law.
Changes
We may update these terms. If a change is significant we will tell you in the app or by email before it takes effect. Continuing to use the service means you accept the updated terms.
